Terms of Service.
1. The service
Nearably, LLC ("Nearably", "we") designs, builds, hosts, and maintains websites for local businesses. A subscription covers one website: its design, content, hosting, security, and reasonable content updates on request (such as hours, services, photos, and contact details).
2. Previews
Preview websites are provided free of charge, without obligation, for a limited period shown on your claim page. Previews are hidden from search engines. If a preview is not claimed, it goes offline automatically. If you want a preview of your business removed sooner, email us.
3. Price, billing & renewal
The subscription price is $499 per year. If you subscribe during your preview period, the price is $399 per year and remains locked at that amount for as long as your subscription stays active. Your subscription renews automatically every 12 months and your payment method on file is charged at renewal. We email you a reminder before each renewal. Payments are processed by Stripe.
4. Cancellation & refunds
You can cancel anytime — via the subscription management link in your Stripe emails, or by emailing hello(at)nearably.com. Cancellation stops future charges; your site stays online until the end of the paid period. Because you can see the complete website before purchasing, initial purchases are not refundable. Renewal charges are refundable within 14 days of the charge if you decide not to continue — email us and we will refund the renewal in full.
5. Your content & our work
You are responsible for the accuracy of business information you ask us to publish and confirm you hold the necessary rights to materials you provide. We may decline content that is unlawful or misleading. The design, code, and arrangement of your site remain Nearably’s property, licensed to you for the duration of your subscription; your business information and materials remain yours.
6. Service & liability
We aim to keep your site online continuously but do not guarantee uninterrupted availability. The service is provided "as is" to the fullest extent permitted by law. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
7. General
These terms are governed by the laws of the State of Delaware, USA. If any provision is found unenforceable, the rest remains in effect. We may update these terms; material changes will be announced by email to active customers. Continued use after changes means acceptance.
